COUNCILMAN EUGENE COOK SPONSORS RESOLUTION
TO SCHEDULE A PUBLIC HEARING TO CONSIDER THE ACQUISITION OF CERTAIN REAL PROPERTY LOCATED IN NORTHPORT, NEW YORK PURSUANT TO SECTION 201 OF THE EMINENT DOMAIN PROCEDURE.
Councilman Cook will sponsor a resolution to schedule a public hearing to consider the acquisition of certain real property located in Northport. The Town Board has determined that it would be in the public interest to consider acquiring Suffolk County Tax Map Numbers 0400-010.00-01.00-003.001, 0400-010.00-01.00-003.002, 0400-011.00-01.00-040.001, 0400-011.00-01.00-036.000 and 0400-010.00-02.00-001.000 being and intended to designate the property known as the Northport Power Plant. The basis of this acquisition will be for the purpose of the delivery to the public of electrical power in a safe and cost efficient manner. After much work by Town Board Members and the Town Attorney’s Office a resolution to schedule this public hearing will be offered on May 17th pursuant to section 201 of eminent domain procedure law.
The Huntington Town Board will vote on scheduling a public hearing at the May 17, 2018, meeting at 7PM at Elwood Middle School 478 Elwood Rd, Elwood, NY 11731 so that the residents of Huntington can be heard on this matter.

RESOLUTION SCHEDULING A PUBLIC HEARING TO CONSIDER THE ACQUISITION OF CERTAIN REAL PROPERTY LOCATED ON WATERSIDE AVENUE AND SEASIDE COURT IN NORTHPORT, NEW YORK, PURSUANT TO SECTION 201 OF THE EMINENT DOMAIN PROCEDURE LAW.

The following resolution is to be offered by: Councilman Eugene Cook
and seconded by:
WHEREAS, the Town Board has determined that it would be in public interest to acquire property located on Waterside Avenue and Seaside Court, Northport, New York, bearing Suffolk County Tax Map Numbers 0400-010.00-01.00-003.001, 0400-010.00-01.00-003.002, 0400-011.00-01.00-040.001, 0400-011.00-01.00-036.000 and 0400-010.00-02.00-001.000 being and intended to designate the property known as the Northport Power Plant for the purpose of the delivery to the public of electrical power in a safe and cost efficient manner; and
WHEREAS, Section 204 of the Eminent Domain Procedure Law requires that within ninety (90) days after the conclusions of said public hearing the Town Board shall adopt and publish its findings and determinations with regard to the effects and purposes of the proposed acquisition; and
WHEREAS, it is necessary for the Town Board to hold a public hearing to consider the acquisition of the subject real property by Eminent Domain; and
WHEREAS, the scheduling of a public hearing is not an action pursuant to 6 N.Y.C.R.R §617.2(b) and, therefore no further SEQRA review of the scheduling of a public hearing is required,
NOW, THEREFORE THE TOWN BOARD
HEREBY SCHEDULES a public hearing to be held on the 5th day of June, 2018 at 2:00 p.m. at Huntington Town Hall, 100 Main Street, Huntington, New York in order to inform the public and to review the public use to be served by proposed public project and the impact on the environment and residents of the locality in connection with the acquisition of certain real property located in Northport, New York, at which time all interested persons shall be afforded the opportunity to make objections and recommendations with regard to said acquisition; and
HEREBY DIRECTS that the Town Clerk shall follow all lawful procedures with Section 202 of the Eminent Domain Procedure Law.
